1. Introduction and Acceptance

These Terms of Service (“Terms”) govern your access to and use of the Blackstars WorldCup Fundraiser platform (“Platform,” “we,” “us,” or “our”), including our website, sponsorship services, and raffle system.

By accessing the Platform, making a sponsorship, or participating in any raffle, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

2. About the Platform

Blackstars WorldCup Fundraiser is a digital sponsorship and raffle platform that gamifies charitable giving by linking sponsorship contributions to soccer events. All raffles are conducted under a valid licence from the National Lottery Authority (NLA) of Ghana, in compliance with the National Lotto Act, 2006 (Act 722) and the Lottery Regulations, 2008 (LI 1948).

3. Eligibility

You must be at least 18 years of age to use this Platform. By making a sponsorship, you confirm you are 18 or older and have the legal capacity to enter into this agreement. Any person found to be under 18 will forfeit any prizes won. We reserve the right to require proof of identity and age at any time.

The Platform is designed for users globally and supports multiple currencies. If you make a sponsorship on behalf of an Organisation, you confirm you are authorised to act on that Organisation’s behalf.

4. Sponsorships

The Platform offers predefined sponsorship tiers tied to soccer events, each earning a specified number of raffle entries as displayed on the Platform. Users may also enter custom sponsorship amounts, with raffle entries calculated accordingly. Sponsorship tiers and entry allocations may be updated from time to time and will always be displayed before you complete a sponsorship.

We currently accept payments via Mobile Money (including MTN MoMo, Vodafone Cash, and AirtelTigo Money), processed through licensed third-party payment providers. Additional payment methods may be introduced in the future and will be displayed on the Platform. A sponsorship is complete only upon successful payment confirmation. No raffle tickets are created for failed or pending transactions.

Upon successful sponsorship, you will receive an on-screen confirmation and an SMS with your sponsorship details and raffle ticket numbers.

Sponsorships are voluntary charitable contributions and are generally non-refundable. Refunds may only be issued in exceptional cases such as confirmed duplicate charges or system errors, and must be requested within 14 days. If a refund is granted, all associated raffle tickets will be voided.

5. Raffle Terms and Conditions

By making a sponsorship and receiving raffle entries, you agree to participate in the raffle system and be bound by these rules. Raffle tickets are generated automatically upon successful sponsorship and assigned a unique ticket number linked to your phone number and transaction.

Raffles are conducted periodically (typically weekly), with defined start, end, and draw dates displayed on the Platform. The Operator may modify schedules, introduce special raffles, or cancel a raffle before the draw at its discretion.

Draws are conducted using a cryptographically secure random number generator. A proof of fairness is stored and may be made available for verification. Each ticket has an equal chance of winning. A single ticket cannot win more than one prize per draw.

Winners are notified via SMS with prize details and a unique claim code, and announced on the Platform website using the winner’s first name and last initial. Winners may request anonymised announcements. Prizes must be claimed within 30 calendar days of the announcement. Low-value prizes are disbursed via mobile money; higher-value prizes require additional verification and are disbursed accordingly. A reminder is sent 7 days before the claim deadline. Unclaimed prizes are forfeited and returned to the prize pool or allocated to a future raffle.

Prizes are forfeited if the winner fails to claim in time, is under 18, or fails identity verification. Winners are solely responsible for any applicable taxes or withholdings under the laws of their jurisdiction.

The Operator may disqualify any participant and void entries for violation of these Terms, fraud, manipulation, or ineligibility.

6. Prohibited Conduct

You agree not to provide false information, use the Platform for unlawful purposes including money laundering, attempt to manipulate the raffle system through bots or fraudulent means, engage in bad-faith chargebacks, interfere with Platform security or performance, or resell raffle tickets. Violations may result in voided entries, prize forfeiture, and referral to authorities.

7. Intellectual Property

All content on the Platform, including the Blackstars WorldCup Fundraiser name, logo, design, graphics, and software, is the property of the Operator or its licensors. You may not reproduce, distribute, or commercially exploit any Platform content without prior written consent.

8. Disclaimer of Warranties

The Platform is provided “as is” and “as available.” We do not guarantee uninterrupted access, error-free operation, or instantaneous payment processing, as these depend on third-party providers and network conditions.

9. Limitation of Liability

To the maximum extent permitted by law, the Operator is not liable for indirect, incidental, or consequential damages, or for losses arising from payment provider failures, network outages, SMS delivery issues, or other third-party service disruptions. Nothing in these Terms excludes liability for negligence, fraud, or anything that cannot be lawfully excluded.

10. SMS Communication Consent

By making a sponsorship, you consent to receiving transactional SMS (confirmations, winner notifications, claim reminders) and promotional SMS (upcoming raffles and campaigns). You may opt out of promotional SMS at any time by replying STOP or contacting us.

11. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, government actions, power or internet failures, or third-party service disruptions.

12. Dispute Resolution and Governing Law

If a dispute arises, you agree to first attempt informal resolution by contacting us. These Terms are governed by the laws of the Republic of Ghana, and any legal proceedings shall be brought exclusively in the courts of Ghana.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via SMS, email, or a Platform notice. Continued use after changes constitutes acceptance. If you disagree, you must stop using the Platform.
